The petitioner apprehends his arrest in connection with Kargahar P.S. Case No. 97 of 2014 registered under Section 366 of the Indian Penal Code.
The allegation of informant Bikrama Ram is that his Bahu (wife) Seema Devi aged about 19 years went to Tilakapur to take medicine on 22.04.2014, but she did not return. The informant had gone to work outside, when he returned in the evening then he found that the box of his wife and his mother were broken and Cash of Rs. 15,000/- was also missing. He searched his wife, but no trace was found. In course of search in the village, he came to know that his wife had gone to Banarsi Ram giving her false address. His wife used to talk always on mobile no. 8521691279.
Patna High Court Cr.Misc. No.50430 of 2015 (2) dt.07-12-2015 2/2 Learned counsel appearing on behalf of the petitioner submits that the petitioner happens to be the father of the informant and father-in-law of the victim. In fact, the victim had gone without giving information to her Maika but only to justify her movement, she made false allegation of attempt to commit rape in her statement. Moreover, after realizing the mistake, the victim has filed the compromise petition signed by her and informant in the Court of C.J.M., Rohtas at Sasaram, on 27.06.2015, which would appear from Annexure-3 to this petition.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Rohtas at Sasaram in connection with Kargahar P.S. Case NO. 97 of 2014, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
