Mr. Shailendra Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 10-09-2025 Heard Mr. Akash Kumar Mishra, learned counsel for the petitioner and Mr. Shailendra Kumar, learned APP for the State.

2. The petitioner seeks regular bail in connection with Sessions Trial No. 364 of 2024 arising out of Shahpur P.S. Case No. 121 of 2024 dated 23.03.2024 registered for the offence(s) punishable under Sections 302 and 34 of the Indian Penal Code.

3. As per the prosecution story, on 23.03.2024 at about 12:30 A.M., the petitioner along with other co-accused persons allegedly killed the informant's sister namely, Sarali Devi by assaulting her with lathi, danda and knives.

4. The main submissions advanced by petitioner's counsel are that the instant matter relates to murder of the

No.43083 of 2025(3) dt.10-09-2025 2/3 petitioner's wife, in fact, the deceased was only daughter of her parents due to which she was not willing to live in her matrimonial house and on 22.03.2024 she came with her children to her matrimonial house and started creating nuisance with her matrimonial family members, when petitioner objected, then the deceased started inflicting injuries upon herself with a knife which resulted in her death and thereafter the deceased's parental family members fabricated a false story.

5. Learned APP appearing for the State has opposed the bail prayer of the petitioner and referred to paragraph nos. 60 and 61 of the case diary showing the statements of two important witnesses.

Considering the seriousness of the occurrence which relates to murder of petitioner's own wife and admittedly the deceased's body was found in the petitioner's house with several stab injuries and as per the statements of two witnesses referred to above the petitioner killed his wife, in my opinion, it is not a fit case for bail to the petitioner. Accordingly, his prayer for bail stands rejected.

7. According to the petitioner's counsel, the petitioner's trial has started but till today no prosecution witness has been examined, although there are no details regarding the

Patna High Court CR. MISC. No.43083 of 2025(3) dt.10-09-2025 3/3 reasons for non-appearance of prosecution witnesses, however, the trial court is directed to expedite the trial of the petitioner and conclude the same at the earliest.
