JUSTICE SANJAY PRIYA ORAL ORDER 5/ 06-09-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in Salkhua P.S. Case No.183 of 2016 instituted for the offence under Section(s) 409, 420/34 Indian Penal Code.

It has been submitted on behalf of the petitioner by filing Supplementary Affidavit annexing Certificate that he has completed the work of construction up to casting of roof. Aforesaid certificate was issued by the Headmaster of the aforesaid school, which has been annexed as Annexure-2 to the Supplementary Affidavit.

A report was called for from the District Programme Officer, Saharsa, by this Court, which has been received and kept

Patna High Court Cr.Misc. No.33350 of 2017 (5) dt.06-09-2017 2/3 at flag-'B', wherein, it has been mentioned that construction work up to casting of roof has been completed and the petitioner may be given permission to complete the work. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Saharsa, in connection with Salkhua P.S. Case No.183 of 2016, subject to the condition that both the bailors shall be close relative of the petitioner.

The petitioner will complete the remaining work of the school building within a period of six months from the date of his release and for that purpose if further allotment is required, it will be seen by the department concerned.

In the event, work is not completed within the aforesaid period, the Informant will be at liberty to take appropriate action against the petitioner for cancellation of bail of the petitioner.
