Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 363, 366(A) of the Indian Penal Code.

It is alleged that the petitioner along with other accused persons have kidnapped the daughter of the informant. The victim girl in her 164 Cr.P.C statement

Patna High Court CR. MISC. No.52147 of 2021(2) dt.06-04-2022 2/2 has recorded her age as 14 years. She has alleged that this petitioner and two others have forcibly kidnapped her.

It is submitted by learned counsel for the petitioner that for the alleged occurrence of 08.08.2020, the F.I.R has been registered on 17.08.2020. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Considering the fact that the victim in her 164 Cr.PC statement has specifically alleged against the petitioner that he kidnapped and confined her in a room and made assault and the victim being minor aged about 14 years, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

The prayer for grant of anticipatory bail to the petitioner stands rejected.
