1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Amnour P.S. Case No. 37 of 2023 dated 28.02.2023 registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30 and 30(a) of Bihar Prohibition and Excise Act.
3. The main submissions advanced by the learned counsel for the petitioner are that the instant matter relates to the recovery of total 392.160 litres of country made liquor and Indian made foreign liquor from the house of this petitioner and co-accused Anish Manjhi, who has been granted bail by a coordinate bench of this court vide order passed in Cr. Misc. No. 26767 of 2023 and petitioner's case is completely identical to
Patna High Court CR. MISC. No.46728 of 2023(2) dt.31-07-2023 2/2 him. Further submissions are that petitioner has been languishing in jail since 24.04.2023 and against him the investigation has been completed.
4. Learned APP appearing for the State opposes the bail prayer.
5. Considering the above submissions and mainly taking into account petitioner's fair and clean antecedent and the completing of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Amnour P.S. Case No. 37 of 2023 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each to the satisfaction of the Court concerned.
