The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 322, 325, 353, 379 and 504 of the Indian Penal Code. The prosecution case is that a she buffalo died due to electrocution when as protest the mob entered into the office of the power house and made assault. Certain persons including the petitioners were identified from the mob.
It is submitted by learned counsel for the petitioners that the thrust of accusation is against the mob. In fact, live L.T.
Patna High Court Cr.Misc. No.54662 of 2015 (2) dt.03-12-2015 2/2 wire failed down on the ground but in spite of information being given no action was taken by the authorities of the power house, hence, the protest was made by the mob. For the occurrence of 30.05.2015, the FIR was registered on 05.06.2015. Considering the thrust of accusation against the mob and delayed lodging of the FIR, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran, Motihari in connection with Chiraiya (Shikarganj) P.S. Case No.115 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
