====================================================== CORAM: HONOURABLE JUSTICE SMT. NILU AGRAWAL ORAL ORDER 29-08-2016 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends arrest in connection with Nawada Nagar P.S. Case No. 708/15 for offences alleged under Sections 420, 467, 468 of the Indian Penal Code. Allegation is that petitioner along with one another cheated the informant of Rs. 3,00,000/- by making his signature on the quotation given by both of them. It has been submitted by the learned counsel for the petitioner that the petitioner is a dealer of Fuzi Films India Pvt. Ltd and the quotation to the effect of providing the said X-ray machine was Rs. 14,50,000/-, as is evident from First Information

Patna High Court Cr.Misc. No.35041 of 2016 (2) dt.29-08-2016 2/2 Report itself. He submits that the informant had taken loan from the Bank and no case of extracting extra money from the informant is made out against this petitioner, as he is the authorised dealer of said X-ray machine. It has further been submitted that the petitioner has no criminal history, as is evident from paragraph 3 of this petition.

However, learned APP for the State submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.

Be that as it may, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Nawada Nagar P.S. Case No. 708/15, subject to the conditions as laid down under Section 438(2) Cr.P.C.
