1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 366A, 506, 34 of the Indian Penal Code and Sections 8 and 12 of the POCSO Act.

3. Learned counsel for the petitioner submits that the petitioner has antecedent of one case and is on bail and the same case is under Section 498A of the IPC read with other sections.

4. Learned counsel for the petitioner further submits that the informant alleges that the accused persons kidnapped his minor daughter aged about 17 years by a vehicle, it is next alleged that two days, thereafter, the petitioner asked him to get his daughter married to Vikas failing which the consequences

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that from bare perusal of the allegations as alleged in the FIR, it would manifest that at the time of kidnapping, it is not alleged that even the petitioner was present and the petitioner being uncle of Vikas, came to be implicated by alleging that he threatened the informant of getting Vikas married with his daughter, it is next submitted that Vikas and the daughter of the informant who is a major, though in the FIR it is alleged that she is 17 years old, were in love and they eloped and the entire family members came to be implicated.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Agiaon Bazar P.S.
