Counter affidavit has been filed today on behalf of respondents.

The prayer in the writ application was for directing the respondent no. 2 to pass final order under Section 144 of the

Patna High Court Cr. WJC No.1125 of 2014 (4) dt.24-07-2015 2/2 Code of Criminal Procedure, 1973 in Case No. M-696 of 2013 which was reserved on 01.07.2013.

From the counter affidavit it transpires that the order in the case was in fact passed on 01.07.2013. However, because of there being error in the requisition filed on behalf of the petitioner for copy of the same, the same could not be supplied but lateron on fresh requisition made on his behalf on 14.11.2014 the certified copy has been prepared on 27.06.2015. Learned counsel has submitted that the certified copy of the order which is lying in the office of the Sub-Divisional Officer, East Muzaffarpur may be received by the petitioner or his advocate.

In view of the aforesaid, the application stands disposed off.

It would be open for the petitioner or his counsel to collect the certified copy of the order dated 01.07.2013 passed in Case No. M-696 of 2013 from the concerned office. (Ahsanuddin Amanullah, J) Anjani/- U T
