JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Desari Police Station Case No. 159 of 2016 registered for the offences punishable under Section 7 of the E.C Act. Petitioner happens to be Assistant Godown Manager but according to the prosecution case itself, it was driver of the said truck, who diverted the route of the truck. Moreover, the impugned order does not contain any specific material against the petitioner.
Accordingly, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender
Patna High Court Cr.Misc. No.45165 of 2016 (2) dt.22-12-2016 2/2 within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali in Desri Police Station Case no. 159 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
