20-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Derni P.S. Case No. 70 of 2017 registered for the offence punishable under Sections 147, 148, 149, 323, 341, 324, 338, 307 and 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that in fact in the F.I.R. altogether eight persons have been named accused. There are general and omnibus allegation against all of them and the reason for the dispute is said to be partition of land among the co-sharers. Learned counsel further submits that one of the co-accused namely, Saheb Manjhi has already been granted regular bail by learned

Patna High Court Cr.Misc. No.44600 of 2017 (2) dt.20-09-2017 Additional Sessions Judge-X, Saran in B.P. No. 1254/2017.

Learned Additional Public Prosecutor for the State opposes the prayer for bail of the petitioner and accepts that there is general and omnibus allegation. Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, VII, Saran, Chapra, in connection with Derni P.S. Case No. 70 of 2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
