JUSTICE RAKESH KUMAR ORAL ORDER 23-09-2016 At the very outset , Sri Patanjali Rishi, learned counsel for the petitioners, in presence of Sri Sadanand Paswan, learned Special Public Prosecutor for Schedule Caste & Schedule Tribe (Prevention of Atrocities ) Act, 1989 submits that during the pendency of this petition petitioner no. 3 has already been arrested. Accordingly, the petition so far petitioner no. 3 is concerned has become infructuous. Accordingly, the present petition so far petitioner no. 3 is concerned stands dismissed as same has become infructuous.
After some argument, Sri Patanjali Rishi, learned counsel for the petitioners, makes a prayer for disposal of the
Patna High Court Cr.Misc. No.39281 of 2016 (2) dt.23-09-2016 2/2 present petition so that petitioner no. 1, 2 and 4 may appear before the court below and make a prayer for regular bail. The prayer is allowed.
The petition stands disposed of with observation that if within a period of six weeks from today petitioners namely Sohan Sah, Mohan Sah and Rameshwar Sah appear before the court below and make a prayer for regular bail , the learned court below without being prejudiced with this order and also considering the injury report may examine the same and pass appropriate order in accordance with law preferably on the same day.
