The petitioner apprehends his arrest in Excise Case No.245 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has committed no offence and has falsely been implicated in the present case due to previous enmity. There is no specific allegation against the petitioner. The petitioner was not arrested on the spot.

Learned A.P.P. vehemently opposed the prayer for anticipatory bail. It is submitted that 40 litres of country made liquor kept in two sacs tied with the motorcycle was recovered.

Patna High Court CR. MISC. No.2689 of 2021(2) dt.29-10-2021 2/2 The petitioner is the owner of the said motorcycle and he has criminal antecedents. Therefore, the petitioner does not deserve anticipatory bail.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
