The petitioners seek bail in Saharghat P.S. Case No. 15 of 2021, registered for the offence punishable under Sections 363, 366(A)/34 of the Indian Penal Code.

As per the FIR, all the FIR named accused persons including the petitioners kidnapped the minor daughter of informant for the purpose of marriage.

It is submitted on behalf of the petitioners that there is contradiction in the statement of victim girl under Section 161 and section 164 Cr.P.C. There is delay of two days in lodging of FIR. As a matter of fact, father-in-law of petitioner no. 1 Jiwachh Singh had sold a part of his land for the purpose of

Santosh Kumar Singh @ Rajan Singh was interested in purchasing the said land, but Jiwachh Singh sold the land to another person, due to this reason, Santosh Kumar Singh @ Rajan Singh falsely implicated the petitioners and other family members. Petitioners are in custody since 28.06.2021 having clean antecedent. Investigation is complete. Considering the facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Benipatti, Madhubani in connection with Saharghat P.S. Case No. 15 of 2021.
