JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-09-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 02 of 2019, arising out of Vigilance P.S. Case No. 06 of 2019, for the offence under Sections 7(a) of the Prevention of Corruption Act, 1988.

Allegation against this petitioner is that in order to extend favour, the petitioner had demanded bribe of Rs.1,00,00/- (One lakh) and he was caught by the Vigilance Trap Team. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 12.01.2019.

No.45241 of 2019(4) dt.27-09-2019 2/3 Considering the allegation that the petitioner has demanded bribe in order to extend favour to the informant in encroachment case and also noticing the fact that the petitioner has remained in custody for more than eight months, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees one lakh) with two sureties of the like amount each to the satisfaction of Special Judge, Vigilance-II, Patna in connection with Special Case No. 02 of 2019, arising out of Vigilance P.S. Case No. 06 of 2019 subject to the condition that the petitioner shall deposit Rs.1,00,000/- (One lakh) cash in the court below and the same shall be abide by the final outcome in the trial i.e. if the petitioner is acquitted the amount of Rs.

1,00,000/- shall be refunded in favour of the petitioner, otherwise it shall be forfeited with the further condition that the petitioner shall extend full co-operation in the early completion of the trial and he shall attend the Court proceeding on each and every date and in the event if he fails to attend the Court below on two consecutive dates without any cogent reason, the court below shall be at liberty to cancel the bail bonds of the petitioner.
