Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with Madhourah P.S. Case No.151 of 2023 dated 18.03.2023 registered for the offence/s punishable under Section/s 25(1-B)a, 26 and 35 of the Arms Act.

The main submissions advanced by the learned counsel for the petitioner are that as per the allegation this petitioner and co-accused persons namely Firoj Alam and Amit Kumar Ram were apprehended with fire-arms and from the possession of co-accused Firoj Alam one loaded countrymade pistol was recovered and the said co-accused has been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No.38252 of 2023 and as per allegation only

Patna High Court CR. MISC. No.48295 of 2023(2) dt.03-08-2023 2/2 one live cartridge is stated to have been recovered from the possession of this petitioner. Further submissions are that the petitioner has no criminal antecedent and has been languishing in jail since 19.03.2023 and he is a young person and against him the investigation has been completed.

Learned APP appearing for the State opposes the bail prayer.

Considering the above submissions and mainly the petitioner's fair and clean antecedent as well as his young age and completion of investigation against him, this Court is inclined to accept his bail prayer. Accordingly, let the petitioner named-above be released on bail in connection with Madhourah P.S. Case No.151 of 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) sangam/- U T
