JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Phulwarisharif P.S. Case No. 180 of 2018, registered for the offences punishable under Sections 341, 323, 420, 354, 307, 376 and 511/34 of the Indian Penal Code. Allegation against the petitioner is that he has taken Rs.6 lacs from the imformant on the pretext of providing job to her either in the civil court or any other place and there is also allegation against him of committing rape upon her. Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and there is delay in lodging the FIR and that has not been explained. Having heard both sides and in the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender within a period of six weeks and if the petitioner is ready to settle the dispute with the informant, the same shall be considered by the court below and after considering all aspects of the matter the court below will pass an appropriate order. It is made clear that if there is any chance of settlement, learned court below may consider the same and pass an appropriate order.
