JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-06-2021 Heard Mr. Santosh Kumar Pandey, learned advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of her arrest in connection with Kutumba P.S. Case No. 52 of 2020, instituted for the offences under Sections 420, 467, 468 and 471 of the Indian Penal Code.
According to the F.I.R., wrong names were supplied to the department for the benefits to be given to the Agriculturists. This was done at the behest of one Sanjiv Kumar Singh who at the relevant time was Agriculture Advisor and the petitioner who was the Agriculture Coordinator. Learned counsel for the petitioner has submitted that the accusation is based only on suspicion as the password and the I.D. Code had crossed the hands of the petitioner and
Patna High Court CR. MISC. No.40195 of 2020(2) dt.16-06-2021 2/2 another accused person namely, Sanjiv Kumar Singh. Aforesaid Sanjiv Kumar Singh has already been granted anticipatory bail by a Bench of this Court vide Criminal Miscellaneous No. 33089 of 2020.
Regard being had to the afore-stated facts and taking into account the gender of the petitioner, she is directed to be released on bail, in the event of her arrest or surrender before the Court below within a period of eight weeks from the date of receipt/ production of a copy of this order, on furnishing bail bonds of Rs.10,000/- (Rs. Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.S. Case No. 52 of 2020, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
