Petitioners, who are in custody, seek bail in connection with Simari P.S. Case No. 99 of 2018 (G.R. No. 1382 of 2018) registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Informant who is a Dafadar has stated that when he was on patrolling duty he came to know about the murder of Lalmuniya Devi and when he reached at the place of occurrence he found dead body of Lalmuniya Devi lying in front of the hut and on seeing her it appears that somebody killed her with fire arms, none of her family members were present there. It has been submitted on behalf of the petitioners
Patna High Court Cr.Misc. No.56901 of 2018(3) dt.19-11-2018 2/2 that they are innocent. They have been falsely implicated in this case due to dirty village politics. Petitioner No.1 is the son and petitioner No.2 is the nephew of the deceased. FIR is against unknown. There is no any eye-witness of the alleged occurrence. They have no criminal antecedent. They are in custody since 30.07.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Simari P.S. Case No. 99 of 2018 (G.R. No. 1382 of 2018).
