JUSTICE SANJAY PRIYA ORAL ORDER 05-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sadar (Saharsa) P.S. Case No. 618 of 2018 instituted for the offence under Sections 341, 323, 504, 506, 386, 387, 448, 34 of the Indian Penal Code and Section 27 of the Arms Act.
In the written report it is alleged that petitioner along with three accused persons assaulted the informant and took away Rs.2000/- from the informant. The accused persons told the informant that it is 1st installment of Rangdari. He gave threat to informant that second installment of Rangdari amounting to Rs.5,00,000/- will also require to be paid by him, otherwise, he would be killed.
Counsel for the petitioner submits that petitioner is in
Patna High Court Cr.Misc. No.57047 of 2018 (3) dt.05-10-2018 2/2 custody since 23.05.2018. Counsel for the petitioner further submits that there was dispute between Vijay Kumar Mishra (informant) and co-accused Md. Mustafa, as agreement was written by the informant on 19.09.2017 that he will make payment of Rs.4,00,000/- to co-accused Md. Javed , son of Md. Mustafa, and after that, boundary wall on registered land will be constructed.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Sadar (Saharsa) P.S. Case No. 618 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
