Petitioner is in custody since 19.02.2017 in connection with Kanti P.S. Case No. 562 of 2016 registered under Sections 302, 201 and 34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner has not been named in the F.I.R. and mere on the basis of confessional statement of co-accused, petitioner has been implicated in this case. Nothing has been recovered from the conscious possession of this petitioner and he has been rotting in custody for about six months. Considering the facts and circumstances of the case,

No.36911 of 2017 (2) dt.17-08-2017 let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., West Muzaffarpur in connection with Kanti P.S. Case No. 562 of 2016.
