The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

Petitioner was doing painting work in the house of the informant. The informant left the house to attend the marriage and the petitioner is suspected to have committed theft of household articles.

Submission is that false implication is there just to pressurize non-demand of the dues of work done by the petitioner in the house of the informant.

Considering the fact that only suspicion is there

Patna High Court Cr.Misc. No.53141 of 2016 (2) dt.08-12-2016 against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur/Successor Court in connection with Kotwali (Barari) Police Station Case No. 303 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
