1. The petitioner is son of one Sudama Devi, since deceased. During her lifetime, she worked as a Group D staff in the office of the Executive Engineer, Command Area Development Commissionary, Bhagalpur. After his death, the petitioner filed an application for compassionate appointment on the ground that her mother was the sole bread-earner of their family. There is no other person to maintain the family and accordingly her application for compassionate appointment ought to be considered. The said application was filed on 25th of November 2020, that is within one year and fifth month from the death of the mother of the petitioner.

2. It is the grievance of the petitioner that said

Patna High Court CWJC No.10390 of 2024(2) dt.11-07-2024 2/2 application has not been disposed of as yet.

3. The learned Advocate on behalf of the StateRespondents very fairly submits that Respondent No. 3 may be directed to dispose of the application dated 25th of November, 2020 filed by the petitioner for his appointment on compassionate ground.

4. In view of such circumstances, the instant writ petition is disposed of directing the Respondent No. 3 to dispose of the application filed by the petitioner on 25th of November, 2020 for compassionate appointment within 90 days from the date of communication of this order.

5. If it requires that for proper disposal of the application, the petitioner is to be heard, the Respondent No. 3 shall give opportunity of hearing to the petitioner or his authorized representative before disposal of such application.

6. With the above order, the instant writ petition is disposed of.
