JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-10-2018 The petitioners seek regular bail in connection with Giriyak P.S. Case No. 230 of 2018, registered for offences punishable under Sections 379 of Indian Penal Code and later added Section 411 of the Indian Penal Code.

Allegation is of commission of theft of motorcycle of the informant and the said motorcycle was recovered from co-accused of this case, who confessed the names of petitioners. Apart from that petitioners are also an accused in one more case of similar nature.

It has been submitted on behalf of the petitioners that save and except the confessional statement of the co-accused,

Patna High Court Cr.Misc. No.60978 of 2018 (3) dt.10-10-2018 there is absolutely nothing against the petitioners, they have been in judicial custody 7.7.2018.

Heard learned A.P.P. also.

Having heard both sides, considering the fact and circumstances of the case and also the criminal antecedent of the petitioners, at this stage, I am not inclined to enlarge the petitioners on bail. However, once the petitioner completes five months in judicial custody, the court below shall release the petitioners on bail to his own satisfaction.
