Patna High Court CR. MISC. No.46705 of 2019(2) dt.29-07-2019 2/3 This application for anticipatory bail arises out of Chakia P.S. Case No. 35 of 2019 for the offence punishable under Sections 341, 323, 504 498A, 313 and 314 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. There are 11 petitioners, who are family members of the husband of the informant.

Learned counsel appearing on behalf of the petitioners has submitted that the husband of the informant has been allowed anticipatory bail by order, dated 28.06.2019, passed in Cr. Misc. No. 39744 of 2019. He contends that apparently implication of these petitioners is because they are family members of the husband of the informant. Considering the above submission, this application is allowed.

Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIII, Motihari, East Champaran, in Chakia P.S. Case No. 35 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
