The petitioner is in custody since 27.07.2020 in connection with Daudnagar P.S. Case No. 138/2019 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 335 litres of countermade liquor has been recovered from Indigo Car. Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner, but from the Indigo car and petitioner is the owner of the said car.
