Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in a case registered for the offence punishable under Sections304B, 201/34 of the Indian Penal Code.
Petitioner in association of his family members used to torture the complainant for non-fulfillment of demand of dowry and ultimately killed her.
Patna High Court CR. MISC. No.39879 of 2020(3) dt.17-03-2021 2/2 Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that there is general and omnibus allegation against the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 15.05.2020. Learned counsel for the State opposes the prayer for bail and submits that petitioner along with his family members killed the daughter of the informant and concealed her dead body.
Considering the fact that the petitioner is the husband of the deceased, I am not inclined to enlarged the petitioner on bail. Accordingly, his prayer for bail is rejected in connection with Trial No. 2116 of 2020 arising out of Gobardhana P.S. Case No. 17 of 2020 pending before the court of the learned 1st Additional Chief Judicial Magistrate, Bagaha, West Champaran. (Anjani Kumar Sharan, J) devendra/- U T
