The sole petitioner, invoking inherent jurisdiction of this court under Section 482 of the Code of Criminal Procedure has prayed for quashing of an order dated 21.8.2013 passed by learned Additional Sessions Judge- III, West Champaran in Sessions Trial No. 148 of 2011 arising out of Bettiah Town P.S. Case No. 87 of 2007 registered for the offence under section 413, 414/ 34 of the Indian Penal Code. By the said order the learned Additional Sessions Judge has rejected the petition filed under section 227 of the Cr.P.C. for discharge of the petitioner. Learned counsel for the petitioner submits that there was no material even then the petitioner has been made accused

Patna High Court Cr.Misc. No.49246 of 2013 (4) dt.15-07-2016 2/2 in the present case.

While going through the impugned order it is evident that by detailed order after discussing evidences/ material brought on record during investigation the learned Sessions Judge has found prima facie case against the petitioner and rejected the discharge petition. There is no error warranting interference.

The petition stands dismissed.
