1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Nabinagar Police Station Case No. 65 of 2025, dated 02.03.2025, disclosing offences under Sections 191(2)/191(3)/190/126(2)/115(2)/308(3)/109/352/351(2) of the Bhartiya Nyaya Sanhita.

3. The prosecution case, as per the First Information Report, is that on 02.03.2025, at about 10:30 AM in the morning, while the informant was sitting at the door of his in-laws' house, in the meanwhile, the petitioners, along with other accused persons, arrived there having iron-rod, sword,

It has further been alleged that on the order of co-accused Umashankar Singh, Shivam assaulted the informant by means of iron-rod due to which he sustained head injury.

4. Learned counsel for the petitioners submits that that there is land dispute between the parties. He next submits that no specific overt act has been alleged against him and allegation of assault is against co-accused Umashankar Singh/Shivam. He further submits that all the injuries caused to the informant on his head is due to assault by the co-accused persons and injuries are not attributable to the petitioner. The petitioner is having no criminal antecedent.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that no specific allegation is there against the petitioner and there appears to be land dispute between the parties, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate I, Aurangabad, in connection with Nabinagar Police Station Case No. 65 of 2025, subject to the condition laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
