2. Petitioner seeks bail who is in custody since 10.12.2023 in connection with S.Tr No. 1087 of 2025 (Arising out of Beur P.S. Case No. 814 of 2023), F.I.R. dated 08.12.2023 for the offences punishable under Section 302/34 of the IPC and Section 27 of the Arms Act.
3. According to prosecution case, the husband of the informant was shot dead by three unknown persons who came on motorcycle while the informant's husband along with his friend was walking.
4. Learned counsel for the petitioner submits that the
2/4 the petitioner move before this court for grant of regular bail in Cr. Misc. No. 40378 of 2024, but the same was rejected vide order dated 18.09.2024 by this Court. Thereafter, the petitioner has again moved before this Court in Cr. Misc. No. 28321 of 2025, but the same was dismissed as withdrawn vide order dated 25.04.2025 with a liberty to the petitioner to renew his prayer before the learned court below. Thereafter, the petitioner approached this Court.
5. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present. The petitioner is not named in the FIR and his name has been transpired during investigation and thereafter, the petitioner has confessed his guilt in the present occurrence and some clothes have been recovered from the house of the petitioner which was used by the co-accused persons during the crime in question. He further submits that similarly situated, coaccused, namely, Dheeraj Singh @ Baba @ Dheeraj Kumar has been granted privileged of regular bail by this Court vide order dated 28.02.2025 passed in Cr. Misc. No. 80052 of 2024 and coaccused, namely, Ramashish Kumar @ Ashish Kumar @ Shutur Baba has been granted privilege of regular bail vide order dated 09.05.2025 passed in Cr. Misc. No. 547 of 2025 and trial has
3/4 not been progressed. The petitioner is in custody since 10.12.2023.
6. Vide order dated 07.07.2025, a report was called for with regard to the present stage of trial. Report of the learned Trial Court dated 15.07.2025 reveals that out of 14 charge-sheet witnesses, the prosecution has examined only three witnesses.

Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner and submits that on the basis of confessional statement, some clothes which were used by the other co-accused persons have been recovered from the house of the petitioner and apart from that the petitioner carries four criminal antecedent other than the present one but fairly submits on the basis of paragraph 3 of the bail petition that the petitioner is on bail in the pending matters.

Considering the aforesaid facts and circumstances, report of the learned Trial Court, period of custody and also the fact that similarly situated co-accused persons have been granted bail by this Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Patna in connection with S.Tr No. 1087 of 2025 (Arising out of Beur
4/4 P.S. Case No. 814 of 2023), subject to the following conditions:- i. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below. ii. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
iii. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
