The petitioner apprehends his arrest in Ballia P.S. Case No. 192/2014, registered for the offences punishable under Section 376 and other Sections of the Indian Penal Code. The petitioner is alleged to have committed rape with the prosecutrix.
It is submitted that there is inordinate delay in lodging the case. Medical evidence does not support the contention of the prosecutrix about the rape and the sons of the petitioner were also present. The story is not believable.
Learned counsel for the State, however, opposed the prayer for anticipatory bail.
Patna High Court Cr.Misc. No.28564 of 2015 (3) dt.12-10-2015 2/2 Considering the facts aforesaid and nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
