This is an appeal under Section 14(A) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for bail vide order dated 07.08.2018 passed by the learned Additional Sessions Judge-I-cum-Special Judge, Saharsa, in Special Case No.380 of 2017, arising out of Saharsa Sadar Mahila Police Station Case No.12 of 2017, registered under Sections 376/323 of the Indian Penal Code and Section 3(1)(r)(s)(w)(ii)) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Allegation against the appellant is of commission of

Patna High Court CR. APP (SJ) No.3486 of 2018 dt.20-12-2018 2/2 rape. This Court had refused to grant bail to the appellant on 10.01.2018 in Cr. Appeal (SJ) No.3438 of 2017. No fresh material has been brought on the record to reconsider and grant bail to the appellant. Hence, his prayer for regular bail is refused. The learned trial Court is directed to expedite the trial and conclude the same preferably within nine months.

Accordingly, the appeal stands dismissed.
