Petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. Submission is that petitioner has been named in the case on the basis of confessional statement of the petitioner before the Police in some other case while in Police custody and this is the only evidence against the petitioner. No incriminating article was recovered from the possession of the petitioner. Petitioner is in custody since 24.08.2018. Investigation of the case is already complete.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the

Patna High Court CR. MISC. No.40262 of 2019(6) dt.26-09-2019 2/2 like amount each to the satisfaction of learned court below where the case is pending in connection with Sabour Police Station Case No.239 of 2018, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
