JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-08-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A and 504/34 of the Indian Penal Code.

The prosecution case is that on 10.05.2016 the minor daughter of the informant Prity Priya went to market for purchase of article but she did not return. Subsequently, the informant came to know that she has been abducted by the petitioner and others for the purpose of marriage then the informant went to the house of the petitioner when the petitioner and his family members abused and threatened the informant.

It is submitted by the learned counsel for the petitioner that for the occurrence of 10.05.2016, the FIR was registered on

Patna High Court Cr.Misc. No.35630 of 2016 (2) dt.31-08-2016 2/2 19.05.2016. In 164 Cr. P.C. statement, the victim got her age recorded as 17 years when the court has assessed her age between 16 to 17 years whereas as per the medical assessment, the victim was found between 18 to 19 years. In 164 Cr. P.C. statement, the victim stated that she of her own went to the house of her maternal aunt and the case has been lodged only on suspicion. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the 164 Cr. P.C. statement of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Darbhanga in connection with Bahadurpur P.S. Case No. 196 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
