This is a petition for grant of anticipatory bail for offence under Sections 363, 366A, 372 and 120B of the Indian Penal Code.
According to first information report, the petitioner and others kidnapped Ragini Kumari, the minor daughter of the informant.
The statement of the victim girl reveals that the matter is of love affairs between the victim and co-accused, Rajit Mandal though she has alleged that she was kidnapped by the named accused person, including the petitioner. Submission of the petitioner is that Ranjit Mandal has already been acquitted in the trial.
Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Rahika P.S. Case No. 164 of 2012 corresponding to G.R. No.
Patna High Court Cr.Misc. No.52956 of 2016 (4) dt.09-02-2017 2/2 3635 of 2012 to the satisfaction of the Chief Judicial Magistrate, Madhubani, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code. (Birendra Kumar, J) SA/- U √ T √
