The petitioner has prayed for bail in a case registered for the offence punishable under sections 302, 201/34 of the Indian Penal Code.

As per allegation in the FIR, accused Sadhu Singh and Arjun Singh taken away nephew of the informant and till late night he did not return. On search, his dead body was recovered from the well situated near the house of late Yaddu Singh. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case on the basis of unsubstantiated suspicion and the confessional statement before the police is inadmissible. Patna High Court CR. MISC. No.43574 of 2022(2) dt.13-02-2023 2/2 accused person has already been enlarged on bail by different Bench vide order dated 11.4.2022 passed in Cr. Misc. No. 54432 of 2021. Petitioner is languishing in judicial custody since 09.05.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda at Bihar Sharif in connection with Harnaut (Chero) P.S. Case No. 340 of 2020.
