Petitioner seeks bail in a case registered under Sections 448, 341, 323, 325, 380/34 of Indian Penal Code. It is submitted by the counsel for the petitioners that though the allegation is of committing theft of valuable ornaments including ornaments from the house of the informant, they have been arrested near the place of occurrence but no recovery whatsoever was made from their possession. It is, thus, obvious that they are in no way connected with the crime and they have been falsely implicated in the case. It is also submitted that the petitioners have not got no criminal antecedent prior to the instant

Patna High Court Cr.Misc. No.36974 of 2017 (2) dt.10-08-2017 2/2 case and that they are in custody since 01.06.2017. Another coaccused, namely, Bharat Kumar Modi has already been granted bail by order dated 28.07.2017 passed in Cr Misc No 34436 of 2017.

Considering the aforesaid submissions, petitioners' prayer for bail is allowed. Let the petitioners above named be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Lakhisarai in Chanan Police Station Case No 63 of 2017.
