27-10-2021 Heard learned counsel for the parties.

Earlier, the bail petitioner of petitioner was rejected, vide order dated 05.02.2021 passed in Cr.Misc. No. 38141 of 2020 (Annexure-1).

On last occasion, vide order dated 15.09.2021, a report was called for from the court below regarding stage of the trial, which has been received and kept at flag 'P'. From perusal of report dated 06.10.2021, it appears that after framing of charge, the case is at the stage of prosecution evidence and one witness has been examined till date.

Learned counsel for the petitioner submits that petitioner is in custody since 30.05.2020 and there is no adequate progress in the trial.

Considering the nature of allegation, period of custody and stage of the trial, the bail petition of petitioner is

Patna High Court CR. MISC. No.52349 of 2021(3) dt.27-10-2021 2/2 allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Siwan in connection with Darauli P.S. Case No. 6 of 2020.
