2. The following reliefs have been sought by the petitioner in the present writ application:-

Patna High Court CWJC No.9836 of 2026(2) dt.13-07-2026 2/3 "1. For issuance of writ in the nature of Mandamus or any other writ/writs, order/orders, direct the respondent authority to reconsider the Tender I.D.147172 Banka Jamdaha Road to Madya Nishedh Office in favour of petitioner, in which respondent authority vide Letter No. 528 dated 19.5.2026, Letter issued by the office of Chief Engineer-3, Bhagalpur, Rural Works Department, Bhagalpur has found not fit for Technical Bid on the basis of Payment Certificate annexed by the petitioner in which Memo Number is not mentioned and also direct to participate the petitioner in reTender or any Tender of Rural Works Department."

3. It appears from the records that, by the impugned order dated 19.05.2026, the petitioner was directed to submit his response within a period of five working days. In compliance thereof, the petitioner submitted his reply vide Letter dated 25.05.2026 (Annexure-2). It is submitted that the said reply is awaiting consideration by the competent authority.

4. In view of the aforesaid, without expressing any opinion on the merits of the case, the respondent authorities are directed to consider the petitioner's reply dated 25.05.2026 (Annexure-P/2) and pass an appropriate order, in accordance with law. Before passing any order, the petitioner shall be afforded an adequate opportunity of personal hearing.

5. With the aforesaid observation, the present writ application stands disposed of.
