JUSTICE SUDHIR SINGH ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 461, 379 and 411 of the Indian Penal Code.
Allegation against petitioner is that refined oil, which was stolen from the shop of informant, was recovered from his house and he admitted that the oil was purchased by him from one Gora Lal Jha.
It is submitted on behalf of the petitioner that he has falsely been implicated in the present case. There is no allegation of tampering of witnesses against petitioner. Petitioner is said to have purchased 2 1⁄2 tin of refined oil from one Gora Lal Jha. Petitioner had no knowledge that the said article was theft article. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned
