JUSTICE SANJAY PRIYA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Gurua P.S. Case No. 51 of 2015 instituted for the offence under Sections 302 and 201/34 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the written report. The written report has been filed by Chowkidar levelling allegation that co-accused Arjun Prasad has committed murder of his daughter namely Khushbu Kumari and made her dead body disappeared. Counsel for the petitioner further submits that name of this petitioner has been disclosed by Arjun Prasad in his confessional statement before the police. Petitioner is in custody since 18.05.2018.
Patna High Court Cr.Misc. No.55331 of 2018 (3) dt.08-10-2018 2/2 It is mentioned in paragraph-3 of the bail petition that petitioner has no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati, Gaya, in connection with Gurua P.S. Case No. 51 of 2015, subject to the condition that both the bailors will be the close relatives of the petitioner.
