The petitioner seeks bail in a case registered for offences under Section 414/34 of the Indian Penal Code and Sections 30 (A), 32 (ii), 38(ii), 41(i) of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 655 litres of foreign liquor were allegedly recovered along with two tractors, trailor and three motorcycles from the orchard of one Avinash Kumar @ Jhiguni Rai where the five persons including the petitioner is said to be assembled for selling the same. It is

Petitioner claims that he is having clean antecedent and is in custody since 18.07.2017. Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Vaishali at Hajipur in connection with Patepur P.S. Case No. 62 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
