The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Complaint Case No. C 1903 of 2018 instituted for the offence punishable under Sections 420 and 406 of the Indian Penal Code and Section 138 of N.I. Act.

As per allegation in the FIR, petitioner has misappropriated huge amount of complainant by way of giving him a cheque which got dishonoured due to insufficient fund. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no

Learned counsel for the informant and learned APP appearing for the State has opposed the prayer of bail and submitted that petitioner is a habitual offender. Having heard learned counsel for the parties and considering the gravity of the case, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected.
