The petitioners are apprehending their arrest in a case registered under Sections 302, 201/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act. Allegation is that the accused persons including the petitioners killed the daughter of the informant after eight years of marriage due to non-fulfilment of dowry.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioner No.1 is father-in-law and petitioner
Patna High Court Cr.Misc. No.52267 of 2016 (2) dt.07-12-2016 2/2 No.2 is the mother-in-law of the deceased. They are separate in mess and property from the husband of the deceased. The husband is in custody.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bagaha, District West Champaran in connection with Gobardhana (Dumri) P.S. case No.18 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
