Mr. MD. NAZIR ANSARI ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 21-09-2017 I have heard learned counsel for the petitioners and the State.

The petitioners seek bail in a case registered for offences punishable under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, huge recovery of foreign liquor was from a truck. It is further contended that the petitioners have not been named in the first information report. However, petitioners claim that they were neither arrested on spot nor was anything recovered from their possession rather their names have come later on stating that the petitioners are involved in a trade of illicit liquor. It is further contended that co-accused, namely, Krishna has been granted bail vide

Patna High Court Cr.Misc. No.46389 of 2017(2) dt.21-09-2017 2/2 Annexure 2. Petitioners claim that they are in custody since 31.3.2017.

Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge II - cum - Special Judge, Excise, Nawada, in connection with Hisua P.S. Case No. 277 of 2016.

If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
