The petitioner seeks bail in Ujiyarpur P.S. Case No. 32 of 2017 registered under Sections 115 and 120B/34 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

Rani Jha is said to have hired criminals for committing murder of Mukhiya Manoranjan Kumar Giri. One of the miscreants, namely, Kanhaiya Kumar was apprehended by the police along with arms and ammunition while others managed to escape.

It is submitted by learned counsel for the petitioner that the petitioner was not apprehended on the spot. Nothing

Patna High Court Cr.Misc. No.46123 of 2017 (2) dt.20-09-2017 2/2 incriminating article has been recovered from his conscious physical possession. His name has surfaced in the case only on the basis of confessional statement of the co-accused Kanhaiya Kumar who has been enlarged on bail by a co-ordinate bench of this court in Cr. Misc. No. 35576 of 2017 vide order dated 10.08.2017. The petitioner has been languishing in custody since 26.03.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dalsingsarai, Samastipur in connection with Ujiyarpur P.S. Case No. 32 of 2017.
