JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-10-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Siwaipatti P.S. Case No. 37 of 2016 registered under Sections 147, 148, 149, 341, 342, 323, 307, 379, 332, 353, 186, 152, 427, 504 and 506 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that the F.I.R. was lodged against 75 persons, including the petitioners and 150 unknown with general allegation about raising slogans and making protest against the death of boy in an accident and they did not allow the Police Party to remove the dead body, but no specific Overt Act has been alleged against

Patna High Court Cr.Misc. No.44458 of 2016 (2) dt.25-10-2016 2/2 the petitioners. Moreover, similarly situated 12 co-accused, named in the F.I.R., have already been allowed anticipatory bail vide Cr. Misc. No. 29640 of 2016 on 30.08.2016.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Judge-9-cum-A.C.J.M., Muzaffarpur in connection with Siwaipatti P.S. Case No. 37 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
