====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-10-2021 Heard Shri Siddharth Harsh, learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is seeking anticipatory bail in connection with Sasaram (T) P.S. Case No. 121 of 2020 instituted for the offences under Sections 341, 325, 308, 354(B), 427 and 34 of the Indian Penal Code.
Learned counsel for the petitioner, at the outset, submits that the petitioner is a person with clean antecedent. It is further submitted that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the informant has alleged that on 10.02.2020 at about 6 pm, the petitioner who had married the informant in a temple about 10 years back had come to her place and started trying to take away the informant as the petitioner wanted the informant to come to his house as his
Patna High Court CR. MISC. No.41008 of 2020(3) dt.29-10-2021 2/3 mother was calling her. The informant accompanied the petitioner on his bike but on way the petitioner pushed the informant down from the bike resulting into injury on the person of the informant and the other accused persons who were standing there, assaulted the informant and tried to outrage her modesty.
The learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the same does not inspire confidence as the informant has alleged that she was married ten years back with the petitioner and had come to her mother's place fifteen days back when this petitioner came and asked her to accompany him to his house as his mother was calling her and then would try to get the modesty of his wife outraged by other persons. The learned for the petitioner further submits that the informant is married to one Birju Sonkar and has children out of that marriage which gets corroborated from the statement made in the F.I.R. itself. He further submits that the petitioner has been falsely implicated in the present case.
Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of the petitioner. Be that as it may, let the petitioner in the event of his
