JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-11-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 302, 201, 326(A), 34 of the Indian Penal Code.
The prosecution case is that on 13.04.2015 the husband of the informant went outside the house on the call of nature but he did not return. Next day his dead body was found hanging in a bamboo clump when his face was disfigured by sprinkling acid. The snifer dog after smelling the sandal of the husband of the informant and the dead body entered into the house of the petitioners. Hence, suspicion was raised against the petitioners.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.51436 of 2015 (2) dt.10-11-2015 2/2 petitioners that petitioners were on inimical term with the informant's side from before and only on suspicion the accusation has been levelled. Moreover considering the fact that there is no direct material against the accused persons similarly situated co-accused have been granted anticipatory bail vide Cr. Misc. No. 44528 of 2015.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Birpur, Supaul in connection with Birpur P.S. Case No. 67 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
