Patna High Court CWJC No.666 of 2015 (3) dt.15-02-2017 2/2 learned AC to GP No. 10 and Sri Girijesh Kumar, learned counsel for the respondent no. 5 for granting further time for filing reply to the counter affidavit.
In this case earlier vide order dated 24.1.2017 three weeks time was already granted. Sri Girijesh Kumar, learned counsel for the respondent no. 5 by way of referring to the statement made in paragraph no. 5 of the counter affidavit of respondent no. 9 submits that the grievance which was raised in the present writ petition has already been redressed. He submits that in the writ petition petitioners have made a prayer for directing for payment of his remuneration from the month of February 2010 to October 2012 whereas statement made in paragraph no. 5 of the counter affidavit makes it clear that the petitioners started their work from 9.2.2010 and continued till 3.3.2010 and their remuneration for the said period had already been paid.
In view of the statement made in paragraph no. 5 of the counter affidavit, there is no reason to further keep the matter pending.
The writ petition stands disposed of.
